Directors & Officers Liability Suit
On February 5, 2010, The Law Offices of Thomas W. Harrity, LLC filed a major jury lawsuit alleging negligence, breach of contract, breach of fiduciary duties and other causes of action naming multiple individuals who served as condominium council members for the Court at Old Swede's at One Christian Street in Philadelphia, Pennsylvania. Mr. Harrity is trying to consolidate this matter with a prior lawsuit entitled, Condominium Association of the Court at Old Swede's vs. Emily Stein-O'Brien, CCP Philadelphia March 2005, No. 00403. That case originated as collection action by the condominium association against the firm's client, Emily Stein-O'Brien, to collect past due condo fees. Ms. Stein O'Brien counterclaimed against the condominium association alleging breach of fiduciary duties in failing to maintain "common elements" including the roof which caused significant property damage and lost rental income. In July 2007 after a four (4) day jury trial, Mr. Harrity successfully defended Ms. Stein-O'Brien and also obtained a $300,000.00 judgment in her favor on her counterclaim. The condominium association appealed the verdict and two (2) years later the case was reversed and remanded. Now the case will be re-tried possibly with the new action consolidated....
